Terms of Service

Agreement

These terms govern access to and use of the Tamson platform, provided by Tamson (Pty) Ltd, registered in South Africa ("Tamson", "we", "us"). By creating a Tamson account or using our WhatsApp chatbot service, a business ("you", "customer") agrees to these terms.

The service

Tamson lets a business connect a WhatsApp Business number, configure automated replies, and manage customer conversations from a shared dashboard. Tamson relies on the WhatsApp Business Platform operated by Meta, and your use of WhatsApp messaging through Tamson is also subject to Meta's own Business Terms and WhatsApp Business Terms of Service.

Your account

• You must provide accurate business details when signing up.
• You're responsible for who on your team has access to your Tamson account and dashboard.
• You must keep your login credentials secure and tell us promptly if you suspect unauthorised access.

Acceptable use

You agree not to use Tamson to:

• Send unsolicited bulk messages or spam, or otherwise breach WhatsApp's Business Messaging Policy.
• Send content that is unlawful, fraudulent, misleading or infringes someone else's rights.
• Attempt to disrupt, reverse-engineer, or gain unauthorised access to the Tamson platform.
• Use conversation data collected through Tamson for purposes outside serving your own customers.

Fees

Any subscription or usage fees, and the WhatsApp conversation-based charges billed by Meta, will be set out separately when you sign up. We'll give reasonable notice before changing our pricing.

Availability

We aim to keep Tamson available and responsive, but the service depends in part on third-party infrastructure, including the WhatsApp Business Platform, which is outside our control. We are not liable for outages caused by those third-party systems.

Data

Conversation data you collect through Tamson belongs to you as the business customer. Our handling of that data, and of your customers' personal information, is described in ourPrivacy Policy.

Termination

You may stop using Tamson and close your account at any time. We may suspend or terminate access if these terms are breached, including repeated violations of WhatsApp's messaging policies, with notice where reasonably possible.

Limitation of liability

Tamson is provided on an "as is" basis. To the extent permitted by law, Tamson is not liable for indirect or consequential losses arising from use of the platform, including losses caused by outages or changes to the WhatsApp Business Platform.

Governing law

These terms are governed by the laws of South Africa, and disputes will be subject to the jurisdiction of the South African courts.
